1. About BrighterGallery.com
BrighterGallery.com is operated by A Brighter Future Foundation, a 501(c)(3) nonprofit organization (EIN 39-3730854). We sell donated fine art, photography, and collectibles, and reinvest 100% of net proceeds into arts education grants. By using this website or placing an order, you agree to these Terms of Service.
2. Eligibility
You must be at least 18 years old and legally capable of entering into a binding contract to make a purchase. By completing a transaction, you represent that you meet these requirements.
3. Products and Pricing
All works are listed at firm prices unless marked "Inquire." Prices are in U.S. dollars. We reserve the right to correct pricing errors and to withdraw any listing at any time prior to confirmed payment.
Product descriptions, dimensions, condition notes, and provenance information are provided in good faith based on available documentation. We make no representations beyond what is stated in each listing.
4. Orders and Payment
An order is not confirmed until payment is successfully processed. We reserve the right to cancel any order for any reason, including suspected fraud or pricing errors, and will issue a full refund in such cases.
Payment is processed securely through Shopify's payment infrastructure. A Brighter Future Foundation does not store credit card information.
5. Shipping
Insured shipping within the continental United States is included in the purchase price. White-glove delivery is available upon request. International shipping is available for select works — contact us for a quote before ordering.
Works are carefully packed and shipped within 5–10 business days of confirmed payment. Tracking information will be provided by email.
6. Returns and Refunds
All sales are final. Please review our for details regarding damaged or incorrect items.
7. Intellectual Property
Purchasing a work of art does not transfer copyright or reproduction rights. All artist copyrights and intellectual property rights remain with their respective owners. You may not reproduce, distribute, or create derivative works from any artwork purchased through this site without the express written permission of the rights holder.
8. Charitable Proceeds
A Brighter Future Foundation is a registered 501(c)(3) public charity. Net proceeds from sales fund arts education grants. The purchase of artwork is a commercial transaction, not a charitable contribution, and is not tax-deductible as a charitable gift. 9. Limitation of Liability
To the fullest extent permitted by law, A Brighter Future Foundation shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of this website or any purchase made through it. Our total liability for any claim shall not exceed the purchase price of the item in question.
10. Governing Law
These Terms of Service are governed by the laws of the State of Wisconsin, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts of Wisconsin.
11. Changes to These Terms
We may update these Terms of Service at any time. Continued use of the website following any changes constitutes acceptance of the revised terms.
